1. Definitions

- "You," "Your," "Client" refers to individuals or entities using our services.
- "Services" refers to property rental guidance, community introduction, cultural liaison, and related services we provide.
- "Property Owner" refers to individuals or entities who own or manage rental properties in artisan communities.
- "Agreement" refers to these Terms & Conditions together with our Privacy Policy and any service-specific agreements.
2. Acceptance of Terms
By accessing our website, contacting us for information, or engaging our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our services.
You must be at least 18 years old to use our services. By using our services, you represent that you are of legal age to enter into binding contracts in Thailand.
These terms constitute a legally binding agreement between you and Canopy Homes, governed by Thai law.
3. Service Description
3.1 Scope of Services
Canopy Homes provides the following services:
- Property rental guidance in Chiang Mai's artisan communities
- Cultural liaison and community introduction services
- Coordination of property viewings and lease arrangements
- Documentation review and cultural context explanation
- Settling-in support and community integration assistance
3.2 Service Limitations
Our services do not include:
- Property ownership or management on our part
- Legal representation or formal legal advice
- Property maintenance or repair services
- Immigration or visa consultation services
- Financial or tax advisory services
3.3 Service Availability
We strive to maintain consistent service availability but cannot ensure properties matching your specific requirements will always be available. Property availability depends on market conditions and property owner decisions beyond our control.
4. Client Responsibilities
4.1 Accurate Information
You agree to provide accurate, complete, and current information when using our services. This includes personal details, property preferences, financial capacity, and background information necessary for rental arrangements.
4.2 Respectful Conduct
You agree to:
- Treat our staff, property owners, and community members with respect
- Honor scheduled appointments and provide reasonable notice for cancellations
- Approach artisan communities with cultural sensitivity and genuine interest
- Follow guidance provided regarding community customs and expectations
- Comply with Thai laws and local regulations throughout the rental process
4.3 Independent Decision-Making
While we provide guidance and cultural context, all rental decisions are ultimately yours. You are responsible for evaluating properties, reviewing lease terms, and deciding whether to proceed with rental arrangements.
5. Fees and Payment
5.1 Service Fees
Our service fees are clearly stated when you engage our services. Fees are quoted in Thai Baht and depend on the service level you select. Detailed pricing information is available on our Solutions page and in service agreements.
5.2 Payment Terms
- Discovery Service: Payment due upon service completion
- Guidance Service: 50% deposit required to begin, remainder due upon lease signing
- Integration Service: 40% deposit required, 40% upon lease signing, 20% after settling period completion
5.3 Additional Costs
Our fees cover service provision only. You are responsible for all costs associated with the rental itself, including:
- Security deposits and advance rent payments to property owners
- Utilities, internet, and other occupancy costs
- Transportation to property viewings
- Legal fees if you choose to engage independent counsel
- Immigration or visa-related expenses
5.4 Refund Policy
Deposits paid for our services are refundable under the following conditions:
- Full refund if we cannot provide services as described within agreed timeframes
- Proportional refund if you withdraw from services before completion, minus work already performed
- No refund for deposits if you withdraw after lease signing has been completed
- Refund requests must be submitted in writing to [email protected]
6. Property Rental Arrangements
6.1 Facilitation Role
We act as facilitators and cultural liaisons between clients and property owners. We do not own, manage, or control rental properties. Rental agreements are directly between you and property owners.
6.2 Lease Terms
While we review lease documents and explain terms, we are not legal representatives. We encourage you to:
- Read all lease documents carefully before signing
- Ask questions about any unclear terms
- Consider engaging independent legal counsel for complex arrangements
- Understand that lease agreements are governed by Thai law
6.3 Property Condition
We provide information about properties based on our knowledge and property owner representations. You are responsible for inspecting properties and assessing their condition before committing to rental agreements. We do not warrant property condition or suitability for your specific needs.
7. Intellectual Property
7.1 Our Content
All content on our website, including text, images, logos, and design elements, is owned by Canopy Homes or used with permission. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes related to obtaining our services. This license does not include rights to download or modify our content.
8. Disclaimers
8.1 Service Provision "As Is"
Our services are provided "as is" without warranties of any kind, express or implied. While we strive for excellence, we cannot provide certain outcomes regarding:
- Property availability matching your exact requirements
- Timeframes for finding suitable properties
- Rental price negotiations or specific lease terms
- Community integration experiences or relationship development
8.2 No Professional Advice
Information we provide about cultural practices, rental processes, and community characteristics is based on our experience and knowledge but does not constitute:
- Legal advice or representation
- Immigration or visa consulting
- Financial or investment guidance
- Psychological or counseling services
For professional advice in these areas, consult qualified specialists.
8.3 Third-Party Actions
We are not responsible for actions, representations, or decisions of property owners, artisan community members, or other third parties you encounter through our services.
9. Limitation of Liability
9.1 Scope of Liability
To the maximum extent permitted by Thai law, Canopy Homes' total liability for any claims arising from our services shall not exceed the fees you paid for those services.
9.2 Excluded Damages
We are not liable for indirect, incidental, consequential, or punitive damages, including:
- Loss of profits or business opportunities
- Costs of finding alternative housing
- Emotional distress or reputational harm
- Losses arising from third-party actions or decisions
9.3 Force Majeure
We are not liable for service delays or inability to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, civil unrest, or public health emergencies.
10. Indemnification
You agree to indemnify and hold harmless Canopy Homes, our staff, and partners from claims, damages, losses, or expenses (including legal fees) arising from your use of our services, violation of these terms, or violation of Thai laws or third-party rights.
11. Termination
11.1 Termination by You
You may terminate our services at any time by providing written notice. Refunds for unused services will be calculated based on work completed, as outlined in our refund policy.
11.2 Termination by Us
We reserve the right to terminate services if you:
- Provide false or misleading information
- Engage in disrespectful or inappropriate conduct
- Fail to make required payments
- Violate these Terms & Conditions or Thai law
11.3 Effects of Termination
Upon termination, you remain responsible for fees owed for services already provided. We will provide documentation of work completed and handle any refunds owed within 30 days.

The English version of these Terms & Conditions is the authoritative version. If translated into other languages, the English version shall prevail in case of discrepancies.
13. General Provisions
13.1 Entire Agreement
These Terms & Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Canopy Homes regarding our services.
13.2 Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force.
13.3 Waiver
Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision.
13.4 Assignment
You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations to successor entities or affiliates.

14. Changes to Terms

Your continued use of our services after changes become effective constitutes acceptance of the updated terms. If you disagree with changes, you may terminate services as outlined in Section 11.
